Our Story

Kemuncak was founded in Petaling Jaya by practitioners who had observed a consistent gap in how estate and inheritance matters were handled — clients were often passed between departments, given brief verbal advice, and left without a clear written record of their options. The founders set out to change that approach.

The name Kemuncak — meaning pinnacle or summit — reflects the practice's orientation: reaching the clearest possible view of a client's situation, so that informed decisions can be made from a position of understanding rather than anxiety.

Since opening, the practice has focused exclusively on estate planning, probate, letters of administration, and contested inheritance matters. This focus allows Kemuncak to maintain a depth of knowledge in a narrow, technical field — one that touches the lives of families at significant moments.

Estate Planning and Inheritance Law in Malaysia

Malaysia's inheritance landscape is shaped by two concurrent legal systems: civil inheritance law, which applies to non-Muslims and governs the distribution of assets through wills and intestacy rules; and Faraid, the Islamic law of inheritance, which applies to the estate of a Muslim individual and prescribes specific shares for designated heirs. Both systems operate within the same judicial environment, and clients with mixed-faith families or complex arrangements often need counsel that understands how each framework functions and interacts.

For many families, the first encounter with inheritance law comes unexpectedly — following the death of a parent or spouse, with no will in place and little familiarity with the legal steps required. The probate process, or the application for letters of administration, involves court filings, asset identification, debt settlement, and ultimately the distribution of an estate to beneficiaries. Each stage has its own requirements, timelines, and documentation obligations.

Estate planning — undertaken before a death, and often before any urgency is felt — offers the opportunity to reduce the administrative and emotional burden on those who remain. A carefully drafted will, clearly executed and properly witnessed, is the foundation of this planning. Beyond the will, EPF nominations, insurance nominations, and lifetime gift considerations each play a role in how an estate ultimately passes to the next generation.
